Purpose of the Agreed Terms of Use

The following Agreed Terms of Use provides an overview of the agreed principles and practices of use relating to the Onslow Chamber of Commerce and Industry Inc (OCCI) offices located at 16 Second Avenue, Onslow – known as the The Onslow Hub.

Any person or group intending to hire or use the facilities on a short to medium term basis is required to read and acknowledge (by signature) on The Onslow Hub Hire Agreement form that they are prepared to abide by the following Agreed Terms of Use. 

On receipt of the completed Hire Agreement, users will be provided with access to the facility. 

Any discrepancies regarding the Agreed Terms of Use should be forwarded to the Chief Executive Officer (CEO) of the OCCI, in writing and emailed to executive@onslowcci.com.au.

This Agreed Terms of Use relates to hire and or use of office space, meeting facilities and shared facilities at 16 Second Avenue, Onslow.

  1. Terms of Use
    As a user of the The Onslow Hub, I agree to abide by the following practices and procedures:
    1. Familiarise all members of the hiring party with The Onslow Hub health and safety procedures including location of emergency exits(and the emergency evacuation plan - displayed), fire extinguishers and first aid kit.
    2. Turn off all lights and air-conditioning at the end of each day
    3. Lock the facility
    4. Clean kitchen surfaces and sink area
    5. Remove any of their personal food items from the fridge or other spaces
    6. Return furniture to original positions
    7. Report any faults or issues to the OCCI staff
    8. Ensure the bathroom facilities are clean and tidy
    9. Respect the privacy and space of others using The Onslow Hub
    10. Act in a proper and professional manner
    11. The premises are to be used solely by you for permitted activities
    12. Pay for any damage or cleaning that may result during their term of use
  2. When accessing or using The Onslow Hub you must not:
    1. Violate any applicable laws or regulations
    2. Defame, abuse harass, stalk, threaten or otherwise violate the legal rights (including the right of privacy) of others
    3. Attempt to undermine the security or integrity of The Onslow Hub’s computing systems or networks
    4. Attempt to gain unauthorised access to any materials, other than those to which you have been given express permission to access
    5. Install any cabling, IT or telecom connections at The Onslow Hub without the written consent of the OCCI CEO
    6. Alter any part of the setup of The Onslow Hub without the written consent of the OCCI CEO
    7. Hold yourself out as a representative of The Onslow Hub or OCCI, or attempt to assume any obligations on behalf of the OCCI
    8. Leave any valuable possessions unattended in the Premises
  3. When accessing or using The Onslow Hub you agree that:
    1. The OCCI may prohibit or halt any activity in the premises which in it opinion is objectionable, dangerous, unlawful or which is potentially detrimental to The Onslow Hub or OCCI’s reputation
    2. You will report any injuries on premises to the OCCI CEO and provide written record
    3. You will respect the premises and take good care of The Onslow Hub and OCCI property at all times
    4. The whole of the premises remains in the OCCI’s possession and control at all times
    5. The OCCI is entitled to charge you additional costs for printing, photocopying and other administrative tasks
    6. If you fail to make payment in accordance with your agreement you will be liable for any reasonable costs incurred by OCCI in recovering debt (including any legal fees, bank fees, collection agency charges or any other reasonable costs)
    7. The OCCI does not make any representations as to the security of The Onslow Hub’s network or internet connections. You must adopt the security measures (eg encryption) you believe to be appropriate to your circumstances
  4. Confidentiality
    1. You acknowledge and agree that during Your use of the Premises You may be exposed to Confidential Information. “Confidential Information” shall mean all information, in whole or in part, that is disclosed by the OCCI, any employee, affiliate, or agent of the OCCI, or a third party that is non-public, confidential or proprietary in nature.
    2.  Confidential Information also includes, without limitation, information about business, sales, operations, know-how, trade secrets, technology, products, employees, customers, marketing plans, financial information, services, business affairs, any knowledge gained through examination or observation of or access to the facilities, computer systems and/or books and records, any analyses, compilations, studies or other documents or otherwise derived in any manner from the Confidential Information and any information that You are obligated to keep confidential or know or have reason to know should be treated as confidential.
    3.  Your use of The Onslow Hub obligates you to:
      1. Maintain all Confidential Information in strict confidence
      2. Not disclose any Confidential Information to any third parties
      3. Not use any Confidential Information in anyway directly or indirectly detrimental to the OCCI , The Onslow Hub or any third party
  5. Limitation of Liability
    1. To the maximum extent permitted by law, the OCCI excludes all liability and responsibility to You (or any other person) in contract, tort (including negligence), or otherwise, for any loss, including consequential loss, or damage resulting, directly or indirectly, from any use of, the Premises.
    2. the OCCI cannot guarantee uninterrupted, timely, secure or error / virus free access to the Premises, to The Onslow Hub’s network or the internet, and its operation may be interfered with by numerous factors outside of the OCCI’s control
  6. Indemnity
    1. You agree to release, indemnify and keep indemnified the OCCI from and against all actions, claims, costs (including legal costs and expenses), losses, proceedings, damages, liabilities or demands suffered or incurred by the OCCI to the extent arising out of or in connection with Your:
      1. failure to comply with these Terms and Conditions;
      2. use of the Premises
  7. Insurance
    1. The OCCI strongly recommends that You acquire, arrange and maintain for the term of Your use of the Premises:
      1. public liability insurance;
      2. workers compensation insurance; and
      3. insurance to protect Your Property.
  8. Privacy
    1. Privacy is very important to the OCCI, the OCCI will use Your Personal Information only as described in the Privacy Policy. For a complete description of how the OCCI will use and protect Your Personal Information, see the Privacy Policy. If You object to Your Personal Information being transferred or used in this way please advise the OCCI CEO.
  9. Termination
    1. To the maximum extent permitted by applicable law, the OCCI may terminate your access to the Premises, if:
      1. You breach the Agreement and the breach is unable to be remedied; or
      2. You breach the Agreement and, if the breach can be remedied, You fail to rectify any remediable breach within seven (7) days of the OCCI notifying You of the breach and requesting rectification; or
      3. You become insolvent, bankrupt, go into liquidation or become unable to pay Your debts as they fall due; or
      4. Your conduct, or that of someone who attends the Premises with Your permission or at Your invitation, is incompatible with the Good Practice Policy; or
      5. OCCI, acting reasonably, is no longer able to provide You with access to the Premises.
    2. If the Agreement is terminated by the OCCI pursuant to sub clause 10a.(v) the OCCI shall refund You a prorated amount of Your (as applicable).
    3. If the Agreement is terminated pursuant to clause 10a, or if Your the agreement expires, You are required to immediately:
      1. remove Your Property from the Premises;
      2. vacate the Premises in a respectful manner;
      3. leave Your area of the Premises in a clean state; and
      4. return to the OCCI any keys (including access / swipe cards) to the Premises.
    4. If You leave Your Property in the Premises following termination or expiry of Your agreement, the OCCI may dispose of it at Your cost (and charge you accordingly) in any way the OCCI chooses without liability or responsibility to You.
  10. Assignment
    1. You cannot transfer or assign Your dedicated desk or private office space without the OCCI’s prior written consent.
  11. Notices
    1. You acknowledge and agree that any notice given pursuant to these Terms of Use by either Party to the other must be in writing by email and will be deemed to have been given on transmission.
    2. Notices to the OCCI must be sent to executive@onslowcci.com.au. Notices to You will be sent to the email address which You provided when submitting Your Application.
  12. Variations
    1. The Onslow Chamber of Commerce & Industry reserves the right to vary these Terms of Use in relation to The Onslow Hub by publishing them on the website:
      1. Without giving you notice; and
      2. Without giving you any explanation of justification for such variation
